What is the burden of proof required to convict a defendant in a criminal trial?  What is the burden of proof required for a party to prevail in a civil case?  Is the standard the same for each?  Why or why not?  What is the general type of penalty that is imposed on the losing party in a criminal case?  A civil case?  Fully explain any differences.
